1. Your Agreement
Welcome to the Mr. and Mrs. Shogun Affiliate Program (the "Program").
These Terms & Conditions (the "Agreement") form a legally binding contract between you (the "Affiliate," "you") and Dragon Hearts, s.r.o., doing business as Mr. & Mrs. Shogun ("Company," "we," "us").
By checking the "I have read and agree to the Affiliate Terms" box and participating in our Program, you acknowledge that you have read, understood, and agree to be bound by this Agreement. This Agreement governs your actions within the Program, which is technically managed and tracked through the Kickbooster platform.
If you do not agree to these terms, do not participate in the Program.
2. Affiliate Code of Conduct
As an Affiliate, you are a representative of our brand. We expect you to act with honesty and integrity. You agree to:
Be Honest: All your promotional content must be truthful and accurate. You may not make false claims, guarantee results, or mislead customers about our products or services.
Be Transparent: You must clearly and conspicuously disclose your affiliate relationship in all promotions. This includes using disclosures like #ad, #sponsored, or a clear statement like "I may earn a commission if you purchase through this link." This is a legal requirement (e.g., FTC guidelines).
Be Respectful: You will not use our Program in connection with any content that is defamatory, harassing, discriminatory, obscene, illegal, or otherwise objectionable.
Not Spam: You will not use unsolicited commercial email (spam) or any other form of unwanted mass communication to promote our products.
Represent KEYS Accurately (No Medical/Therapeutic Claims): You understand that KEYS is a tool for self-discovery and personal growth, grounded in psychology. You agree NOT to represent KEYS as a substitute for professional medical or psychological diagnosis or treatment. You may not make any medical, therapeutic, or specific healing claims regarding the results of using KEYS.
Uphold the "Guide, Not a Guru" Philosophy: You agree to represent KEYS consistent with its core philosophy: it is a "Guide, Not a Guru". Your promotions should emphasize how KEYS empowers users to find their own answers and inner wisdom, rather than presenting it as a source of definitive external answers or predictions.
Describe Embodied Exercises Appropriately: When mentioning the exercises within KEYS, you agree to accurately represent them as "guided inner processes, sometimes involving gentle body movement or sensory focus... designed to connect you with your intuition and body's wisdom," not as physical workouts or demanding practices.
Maintain Brand Tone & Integrity: While promoting KEYS, strive to maintain a tone that is aligned with the Mr. & Mrs. Shogun brand: respectful, authentic, insightful, and focused on genuine inner work, avoiding overly sensational, esoteric, or "quick-fix" language
3. Brand & Trademark Usage (The "Don'ts")
This is how you protect our name. Violation of these terms will result in immediate termination and forfeiture of all unpaid commissions.
No False Association: You may not create websites, social media profiles, or any content that impersonates the official Mr. & Mrs. Shogun brand. It must be clear that you are an independent partner, not an employee or the company itself.
No Brand Bidding: You are strictly prohibited from bidding on our branded keywords in any paid advertising (PPC) on platforms like Google Ads, Bing Ads, etc. This includes, but is not limited to, keywords such as "Mr. and Mrs. Shogun," "Mr & Mrs Shogun," "Shogun discount," or any misspellings or variations.
No Altering Marks: You may only use the official logos, banners, and marketing materials ("Marks") provided by us. You may not alter, edit, or distort these Marks in any way.
No Domain Names: You may not use our brand name or trademarks (or misspellings) in your domain names or social media handles.
4. Prohibited Marketing Activities
You may not promote our products using cookie-stuffing, pop-up or pop-under windows, or any other method that forces a tracking cookie onto a user's device without their knowledge.
You may not offer "self-referrals" (using your own link to purchase) or any form of cash-back, rebates, or incentives to customers without our prior written permission.
You may not list false discount codes. You may only promote coupons and discounts that we provide to you directly through the Program.
5. Indemnification & Limitation of Liability
Please read it carefully.
Your Responsibility: You are solely responsible for your own conduct and the content you create. Mr. & Mrs. Shogun will not be held liable for any of your actions or representations.
Indemnification: You agree to indemnify, defend, and hold harmless Mr. & Mrs. Shogun, its owners, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) that arise from or are related to:
Your breach of any term in this Agreement.
Any claim of false advertising or misrepresentation made by you.
Your failure to disclose your affiliate status.
Any other harmful or negligent act or omission by you.
6. Termination
Either party may terminate this Agreement at any time, with or without cause, by providing written notice (email is sufficient).
We reserve the right to terminate your participation immediately and without notice if you breach any part of this Agreement, especially (but not limited to) the terms in Sections 3 and 4.
Upon termination, you must immediately remove all affiliate links and our Marks from your properties. If you are terminated for a breach, we reserve the right to forfeit any unpaid commissions.
7. Commissions & Payouts
All affiliate tracking and commission payments are managed through the Kickbooster platform. We will only pay commissions on valid, tracked sales that are not fraudulent or refunded. We are not responsible for commissions lost due to tracking failures.
8. Relationship of Parties
This Agreement does not create any employment, partnership, joint venture, or agency relationship between you and Mr. & Mrs. Shogun. You are an independent contractor and are solely responsible for any and all taxes on your earnings.
9. Modification
We may modify this Agreement at any time by posting updated terms on our website. It is your responsibility to review these terms regularly. Your continued participation in the Program after a modification constitutes your binding acceptance of the changes.
10. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Bratislava, Slovakia.
